1.1. Unless otherwise defined, capitalized terms in this Acceptable Usage Policy (AUP) shall have the meanings ascribed to them in the main body of the Agreement.
1.2. This AUP governs your utilization of the Products, Site, and Services provided by Market4Play, LLC (“Market4Play”).
1.3. The instances provided in this AUP are illustrative and not exhaustive. Market4Play (“we” or “us”) reserves the right to amend this AUP at our discretion and without prior notice.
1.4. Your use of the Site or Services constitutes acceptance and agreement to abide by the latest version of this AUP.
1.5. Any breach of this AUP, or facilitation, encouragement, or assistance to others in breaching it, may result in immediate suspension or termination of your access to the Services, without notice or liability on Market4Play's part.
2.1. Market4Play encourages users to report suspected violations by providing details of the alleged infraction, along with relevant links/pages, through our support link.
2.2. We shall undertake investigations into reported violations and respond as deemed appropriate or necessary, at our sole discretion.
2.3. Users agree to accept the conclusions of any investigation into their complaints without limitation
3.1. Illegal, Harmful, or Offensive Use or Content
3.1.1. Users shall not engage in, or encourage, facilitate, or instruct others to engage in, illegal, harmful, or offensive use of the Products, Site, or Services, including the transmission, storage, display, or distribution of prohibited content.
3.1.2. Prohibited activities or content include, but are not limited to:
3.1.2.1. Illegal Activities. Any activities deemed illegal, such as advertising gambling sites or services without proper authorization, disseminating child pornography, or marketing goods or services prohibited by applicable laws and regulations.
3.1.2.2. Harmful or Fraudulent Activities. Actions that may cause harm to others or our reputation, including the dissemination of fraudulent goods or engaging in deceptive practices.
3.1.2.3. Infringing Content. Content that violates the intellectual property rights of others.
3.1.2.4. Offensive Content. Content that is defamatory, obscene, or otherwise objectionable, including depictions of non-consensual sexual acts.
3.1.2.5. Harmful Content. Content or technology that may damage systems, including viruses or other malicious software.
3.1.2.6. Security Violations. Users shall not violate the security or integrity of any network, computer, or communications system.
3.1.2.7. No Network Abuse. Users shall not make unauthorized network connections or engage in activities that disrupt or overload systems.
3.1.2.8. No E-Mail or Message Abuse. Users shall not distribute unsolicited mass e-mails or messages (spam) or collect replies to messages sent from other providers in violation of this AUP or other providers' policies.
3.1.2.9. Further Prohibited Conduct. Users shall not engage in conduct that facilitates unlawful distribution of copyrighted or trademarked content, or disrupts the functionality or performance of the Site or Services.
3.1.2.10. Origin Falsification. Users must refrain from altering TCP-IP packet headers, email headers, or any message components describing its origin or route, including falsifying or masking identity or source, excluding the use of aliases or anonymous remailers.
3.1.2.11. Network Integrity. Users may only establish network connections with other users, hosts, or networks if they have explicit permission to do so. Prohibited activities encompass:
3.1.2.12. Unauthorized Monitoring or Crawling: Any form of system monitoring or crawling that disrupts or impairs system functionality.
3.1.2.13. Denial of Service (DoS) Attacks: Flooding a target with communication requests to render legitimate traffic ineffective.
3.1.2.14. Intentional Interference: Deliberate actions to disrupt system functionality, such as mail bombing, news bombing, broadcast attacks, or flooding techniques.
3.1.2.15. Unauthorized Operation of Network Services: Operating network services like open proxies, open mail relays, or open recursive domain name servers without proper authorization.
3.1.2.16. Circumvention of System Restrictions: Using manual or electronic methods to bypass system limitations, including access and storage restrictions.
3.1.2.17. Malicious Software: Engaging in activities harmful to others, our operations, or reputation, such as offering or disseminating malware, ransomware, trojans, viruses, worms, etc.
3.1.2.18. Unauthorized Account Creation: Creating fake, unauthorized, or multiple accounts without proper authorization or using stolen credentials.
3.1.2.19. Abuse of Trial Accounts: Creating multiple trial accounts for the purpose of exploiting trial periods, as defined in Section 2.33 of the Terms of Service.
3.2. Email and Message Abuse
Users are prohibited from engaging in the distribution, publication, sending, or facilitation of unsolicited mass email or other messages, including promotions, advertising, or solicitations (commonly known as “spam”), which includes commercial advertising and informational announcements. Additionally, users must not alter or obscure mail headers or assume a sender’s identity without explicit permission from the sender. Furthermore, users are not permitted to collect replies to messages sent from another internet service provider if those messages violate this AUP or the AUP of that provider.
3.3 Further Prohibited Conduct
Additionally, you agree not to:
Facilitate the unlawful distribution of copyrighted or trademarked content.
License, sublicense, rent, or lease the Services to any third party without express permission from Market4Play, LLC.
Advertise to or solicit users who have opted out of marketing communications or unsubscribed from your materials.
Use the Site or Services to stalk, threaten, or harass others.
Collect, use, or disclose data, including Personal Information, without informed consent or in violation of applicable laws.
Obtain access credentials for the purpose of automating logins or gaining unauthorized access to Market4Play’s systems.
Engage in activities that disrupt, diminish the quality, or impair the functionality of the Site or Services.
Attempt to access source code underlying the Site, Services, or other Market4Play technology through reverse engineering or decompilation.
Copy, archive, reproduce, or distribute any part of the Site or Services without express authorization.
Access the Site or Services for competitive purposes, benchmarking, or monitoring without authorization.
Upload content, software, or code designed to breach security, interfere with functionality, or prevent others from accessing the Site or Services.
Upload files larger than 500MB or create more than 5,000 landing pages without prior authorization.
We retain the right, though not the obligation, to oversee the Site and its Services (and any associated usage), as well as to probe any breaches of this AUP or instances of Site or Service misuse. Market4Play reserves the discretion, without assuming liability:
To conduct investigations into breaches of this AUP or misuse of the Site or Services; and/or to take measures such as removing, disabling access to, or modifying any content or resource that we, in our sole judgment, deem to contravene this AUP or any other agreement governing your use of the Site or Services.
We may communicate any suspected unlawful activity to law enforcement agencies, regulators, or any other relevant Third Party. Such communication may entail the divulgence of customer information. Furthermore, we may collaborate with law enforcement agencies, regulators, or other relevant Third Parties to assist in the inquiry and prosecution of unlawful behavior by providing information pertaining to network and system activities related to alleged breaches of this AUP.
