I. Essential Definitions

Client
An entity subscribing to Market4Play’s Apps/Platform/Products.

Prospect
A visitor to pages, funnels, or sites created by Market4Play or by Clients using our platform.

Client Data
Information related to the subscription relationship with Market4Play.

Client Content
All page composition, text, media, and layout created by a Client on our platform.

Prospect Data
Information a visitor submits on a Client or Market4Play page (e.g., form fields).

Personal Information / Personal Data
Information that identifies or can reasonably identify a person (e.g., name, email, phone).

Processing
Any operation on Personal Data (collection, storage, use, disclosure, deletion).

Controller
The party determining purposes and means of processing (often the Client for their Leads/pages).

Processor
A party processing Personal Data for a Controller (often Market4Play for Clients).

Data Subject
The individual to whom Personal Data relates.

Consent
A clear, specific, informed, unambiguous indication of a Data Subject’s wishes.

Legitimate Interests
A legal basis allowing processing where necessary and not overridden by Data Subject rights.

Data Breach
A security incident leading to accidental/unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, Personal Data.

User-Provided Data (UPD)
Identifiers (e.g., email, phone) we may hash and send to measurement/ads tools to improve attribution and conversion accuracy, subject to consent.

Google Consent Mode (v2)
A Google framework that adapts tag behavior (analytics/ads storage) based on user consent.

Global Privacy Control (GPC)
A browser signal that communicates a user’s opt-out preference for targeted advertising.

Targeted Advertising / “Share”
Ads based on a user’s activity across sites/apps; may be considered “sharing” under some US laws.

II. Data Acquisition Procedures

We gather various data types from the Site and/or Services. Our processing of Personal Data is based on explicit consent when required or for providing the Site and/or Services, aligned with our legitimate interests, detailed in "Clause III. How We Use Your Information".

1. Account Information

When you register, we collect your login (email + password) and may collect your name, company, phone, and address. We also collect information you submit via forms and through cookies/SDKs as described below.

2. Financial Transaction Particulars

If you purchase a Subscription, your payment card details are processed by third-party payment processors. We do not store full card numbers. We may store your billing address and transaction metadata. We adhere to PCI standards via our providers.

3. Logistical Data

When you use the Services, we automatically log IP address, timestamps, referrer URLs, approximate geolocation, device/browser characteristics, and similar telemetry. In jurisdictions requiring consent for analytics/advertising, collection and storage are governed by your consent choices (see Section IV – Cookies & Consent).

4. Cookie Mechanics and Log Files

We use cookies and similar technologies to operate our Site, analyze performance, prevent fraud, measure campaigns, and (where permitted) improve ad relevance. For details, categories, regional logic, and your choices, see Cookies & Consent.

5. User Contributions

If you post or submit content to public areas, you do so at your own risk. We cannot control how others use that content.

6. Lead Data

Clients may use our platform to build forms and collect Lead Information. Clients control which fields are collected and why; they act as Controllers for such processing. Market4Play acts as Processor on Clients’ instructions. Clients are responsible for honoring Data Subject rights and deleting Lead Information when no longer needed.

7. WordPress Integration

To publish pages to a WordPress Domain, you may install our Plugin. We collect limited environment details (e.g., WordPress/PHP version, plugin names) to ensure compatibility and support.

III. Utilization of Collected Information

We leverage the data collected based on our legitimate interest in refining the Market4Play platform and ensuring an optimal user experience. Additionally, this data is essential for effectively fulfilling our contractual obligations to you.

  • We limit employee access to Personal Data to those who need it to perform their job.

  • We use data to deliver, maintain, and improve the Services; research, analyze trends, monitor usage, and assess engagement.

  • We may use Personal Data to respond to support and billing inquiries; to administer accounts, billing, invoicing, and account management.

  • Marketing emails are sent with consent or as permitted by law; you can opt out at [email protected].

  • We send essential service communications (e.g., security, outages, billing).

  • We use Personal Data to maintain security, prevent abuse and fraud, respond to security incidents, and protect rights, property, and safety as required by law.

We do not sell your Personal Data for money.

Your Choices
On first visit, our banner lets you Accept All, Accept Essential, or Customize by category. You can change your choice by clearing cookies or using your browser settings. We record your selected categories and timestamp as a consent record.

Regional Display / Consent Mode
For EU/UK visitors, non-essential cookies and advertising are off by default until you grant consent. We honor Global Privacy Control (GPC) signals to opt out of Advertising/targeted ads where required by law.

V. Google Analytics 4 (GA4) & Consent Mode

We use Google Analytics 4 (GA4) to understand how our Site is used and to improve performance. GA4 may set cookies and collect device/usage data. For EU/UK visitors, we implement Consent Mode v2, which denies analytics/ads storage by default and only enables it after consent is granted in our banner.

User-Provided Data (UPD)
Where permitted by your consent and applicable law, we may send hashed identifiers (e.g., email/phone) to GA4 to improve conversion measurement and attribution. Google receives hashed values; we do not permit Google to reidentify users.

Retention
We configure GA4 event retention for up to 14 months (or the nearest available setting). Aggregated statistics may be retained longer. Opt-out options include our banner controls and Google’s opt-out browser add-on.

VI. Advertising & Measurement (Meta Pixel and Conversions API)

Where allowed by your consent and applicable law, we use tools such as Meta Pixel and Meta Conversions API (CAPI) to measure advertising effectiveness, prevent fraud, and improve relevance. These tools may collect or receive event data (e.g., page views, leads, purchases) and may use hashed identifiers (e.g., email/phone) to improve match rates. If we send both browser and server events, we use deduplication.

Your Choices
Disable Advertising in our banner; use platform controls (e.g., Facebook Ad Preferences) and device/browser settings. We honor GPC signals where required by law.

US “Sell/Share” & Targeted Advertising
We do not sell personal information for money. Some analytics/ads disclosures may be considered a “share” or targeted advertising under certain US state laws. You can opt out via our banner (disable Advertising) and by contacting [email protected]; GPC is honored where required.

VII. Disclosure Practices

Your information is shared with Third Parties only at your direction or when essential for a particular service, such as utilizing Third-Party payment processors or incorporating communications and analytics tools, all in accordance with applicable privacy regulations.

  • We do not sell, rent, or disclose your Personal Data without consent, except as permitted in this Policy.

  • Service providers process data under contract and our instructions.

  • We may use or share aggregated/de-identified data that does not identify you.

  • Lead Data is generally housed in the United States; Personal Data may be processed in any country where we or our providers operate (see Section XV – International Transfers & Safeguards).

VIII. Your Privacy Entitlements

Information Governance
Access and update your account/profile information by logging into the Services. If processing exceeds the legitimate basis, becomes unnecessary, or is inaccurate, you may request deletion or correction.

Consent Reversal
Withdraw consent where processing is based on consent; object to unlawful processing under certain conditions.

Data Mobility
You may request copies of Personal Data we retain, and where technically feasible, request transmission to another provider.

Data Constraint and Opposition
You may request restriction of processing under certain conditions or object to decisions taken solely by automated means that produce legal or similarly significant effects.

Regional Rights

  • EEA/UK: Access, rectification, erasure, restriction, portability, and objection. You may lodge a complaint with your supervisory authority.

  • US States (e.g., CA/CO/CT/VA/UT and others): Access, correct, delete, and opt out of targeted advertising or “sharing.” If we deny a request, you may appeal by replying to our decision with “Appeal.”

GPC & Do Not Track: We honor GPC signals for opting out of Advertising/targeted ads where required. We do not respond to legacy “Do Not Track” signals.

Data Preservation
We retain Personal Data as long as necessary or required by law (see Section XVII – Data Retention).

IX. Third Party Website Links

Our Site and Services may include links to other websites. We do not control the privacy practices or content of those sites. Review their privacy policies before providing data.

X. Ownership Transition or Business Changes

In cases of sale, merger, or acquisition, Personal Data (including Lead Data) may be transferred. The acquiring party must agree to adhere to this Policy and provide evidence of the transaction upon request.

XI. Data Security Measures

We employ administrative, technical, and organizational measures (encryption in transit, access controls, logging/monitoring, vendor diligence, regular testing) designed to protect Personal Data. No method of transmission or storage is perfectly secure; use strong, unique passwords and protect your devices. Users are responsible for securing their systems.

XII. Children’s Privacy

Our Site and Services are not intended for children under the age of 16, and we do not knowingly collect Personal Data from individuals under 16 without appropriate consent. If we become aware of such data, we will delete it. Parents/guardians may contact us to request deletion.

XIII. Resolution/Compliance

XV. International Transfers & Safeguards

We may transfer Personal Data to the United States and other countries where we and our service providers operate. Where required, we rely on appropriate safeguards such as Standard Contractual Clauses (SCCs) and complementary measures. XVI. Service Providers / Subprocessors

We use vetted service providers to host, analyze, communicate, process payments, provide security, and support operations. We maintain a current list at https://www.market4play.com/subprocessors. Each provider is bound by contract to protect Personal Data and process it only on our instructions.

XVII. Data Retention

We retain Personal Data only as long as needed for the purposes described or as required by law. Typical periods:

  • Leads & Account Records: For the life of the account and up to 24 months after last activity, unless a longer period is required or you request deletion.

  • Analytics (GA4) Events: Up to 14 months (per our GA4 configuration).

  • Advertising Events (e.g., Meta): Generally up to 24 months for measurement and fraud prevention.
    When no longer needed, we delete or de-identify the data.

XVIII. Modifications to this Privacy Policy

Market4Play may modify this Policy periodically. The “Last Updated” date above reflects the latest changes. Your continued use of our Website, Platform, or Services following publication of changes signifies your acknowledgment and consent to the updated Policy.
